1. Description of Service

SpeedMark is a mobile application that automatically tracks your vehicle's speed using GPS technology and creates tamper-proof evidence that can be used to challenge traffic citations or legal disputes.

2. Eligibility and Account

You must be at least 16 years old to use SpeedMark. By using the app, you represent that you meet this age requirement and have the legal capacity to enter into these terms.

3. Acceptable Use

Permitted Uses

• Using SpeedMark for personal speed verification and legal evidence
• Exporting your own speed data for legitimate purposes
• Using the app in compliance with local traffic and privacy laws

Prohibited Uses

• Using the app while driving in a manner that causes distraction
• Using exported data to make false claims or commit fraud
• Sharing or selling your exported data to unauthorized third parties

• All speed and location data is stored locally on your device
• We only retain the last 2 minutes of driving data
• Your data is never sold to third parties
• You maintain full control over your data export and deletion

5. Accuracy and Legal Disclaimer

GPS Accuracy Limitations

• GPS accuracy can be affected by weather, buildings, tunnels, and other environmental factors
• Reported accuracy is typically 3-10 meters in optimal conditions
• SpeedMark provides the best available data but cannot account for all variables

6. Subscription and Payment Terms

Subscription Service

SpeedMark operates on a subscription basis. Subscription fees are charged through the App Store and are subject to Apple's terms and conditions.

Free Trial

We may offer a free trial period. If you do not cancel before the trial ends, you will be automatically charged for a full subscription period.

Cancellation

You can cancel your subscription at any time through the App Store. Cancellation takes effect at the end of the current billing period.

Refunds

Refund requests are handled by Apple through the App Store and are subject to their refund policies.

7. Service Availability

We strive to maintain SpeedMark's availability, but we do not guarantee uninterrupted service. We may temporarily suspend the service for maintenance, updates, or other operational reasons.

8. Content and Data Ownership

You retain ownership of all data generated by your use of SpeedMark, including speed logs and exported files. SpeedMark retains ownership of the app's technology, algorithms, and underlying software.

9. Prohibited Conduct

You agree not to:

• Use SpeedMark for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with other users' use of the service
• Upload or transmit any harmful code or malware
• Violate any applicable local, state, or federal laws

10. Limitation of Liability

To the maximum extent permitted by law:

• SpeedMark is not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the subscription fees you paid in the 12 months preceding the claim
• We are not responsible for legal outcomes resulting from use of exported data

11. Warranty Disclaimer

SpeedMark is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless SpeedMark and its owners from any claims, damages, or expenses arising from your use of the app or violation of these terms.

13. Termination

We may suspend or terminate your access to SpeedMark at any time for violation of these terms. You may stop using the app at any time. Upon termination, your local data remains on your device until you delete it.

14. Governing Law

These terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of North Carolina, Mecklenburg County.

15. General Provisions

If any provision of these terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These terms constitute the entire agreement between you and SpeedMark.

16. Service Modifications

We reserve the right to modify, suspend, or discontinue SpeedMark at any time. We will provide reasonable notice of significant changes that affect your use of the service.

17. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify users of material changes through the app or our website. Continued use of SpeedMark after changes constitutes acceptance of the updated terms.
